Funds appropriated by this Act or otherwise made available to the Department of State for payments to the Working Capital Fund may only be used for the service centers included in the Congressional Budget Justification, Department of State, Foreign Operations, and Related Programs, Fiscal Year 2020: Provided , That the amounts for such service centers shall be the amounts included in such budget justification, except as provided in section 7015(b) of this Act: Provided further , That Federal agency components shall be charged only for their direct usage of each Working Capital Fund service:
Provided further , That prior to increasing the percentage charged to Department of State bureaus and offices for procurement-related activities, the Secretary of State shall include the proposed increase in the Department of State budget justification or, at least 60 days prior to the increase, provide the Committees on Appropriations a justification for such increase, including a detailed assessment of the cost and benefit of the services provided by the procurement fee: Provided further , That Federal agency components may only pay for Working Capital Fund services that are consistent with the purpose and authorities of such components:
Provided further , That the Working Capital Fund shall be paid in advance or reimbursed at rates which will return the full cost of each service. Funds made available by this Act are made available to support the permanent Foreign Service and Civil Service staff levels of the Department of State at not less than the on-board levels in fiscal year 2016. The use of funds appropriated by this Act to implement any plan to expand or reduce the size of the permanent Civil Service or Foreign Service workforce at the Department of State from on-board levels in fiscal year 2016 shall be subject to prior consultation with, and the regular notification procedures of, the Committees on Appropriations:
Provided , That such notification shall include the requirements enumerated in section 7062(b) of this Act. Not later than 60 days after enactment of this Act, and every 60 days thereafter until September 30, 2021, the Secretary of State shall report to the appropriate congressional committees on the on-board personnel levels, hiring, and attrition of the Civil Service, Foreign Service, eligible family member, and locally employed staff workforce of the Department of State, on an operating unit-by-operating unit basis:
Provided , That such report shall also include a hiring plan, including timelines, for maintaining the agency-wide, on-board Foreign Service and Civil Service at not less than the on-board levels in fiscal year 2016. None of the funds appropriated by this Act, prior Acts making appropriations for the Department of State, foreign operations, and related programs, or any other Act, may be used to downsize, downgrade, consolidate, close, move, or relocate the Bureau of Population, Refugees, and Migration, Department of State, or any activities of such Bureau, to another Federal agency.
Funds appropriated by this Act— under the heading Migration and Refugee Assistance shall be administered by the Assistant Secretary for Population, Refugees, and Migration, Department of State, and this responsibility shall not be delegated; and that are made available for the Office of Global Women’s Issues shall be administered by the United States Ambassador-at-Large for Global Women’s Issues, Department of State, and this responsibility shall not be delegated. None of the funds appropriated in title I of this Act under the heading Administration of Foreign Affairs may be made available for a new major information technology
(IT)investment without the concurrence of the Chief Information Officer, Department of State. None of the funds made available by this Act and prior Acts making appropriations for the Department of State, foreign operations, and related programs may be used by an agency to submit a project proposal to the Technology Modernization Board for funding from the Technology Modernization Fund unless, not later than 15 days in advance of submitting the project proposal to the Board, the head of the agency— notifies the Committees on Appropriations of the proposed submission of the project proposal; and submits to the Committees on Appropriations a copy of the project proposal. None of the funds made available by this Act and prior Acts making appropriations for the Department of State, foreign operations, and related programs may be used by an agency to carry out a project that is approved by the Board unless the head of the agency— submits to the Committees on Appropriations a copy of the approved project proposal, including the terms of reimbursement of funding received for the project; and agrees to submit to the Committees on Appropriations a copy of each report relating to the project that the head of the agency submits to the Board. Up to $93,000,000 of the funds made available in titles III and IV of this Act pursuant to or to carry out the provisions of part I of the Foreign Assistance Act of 1961, including funds appropriated under the heading Assistance for Europe, Eurasia and Central Asia , may be used by the United States Agency for International Development to hire and employ individuals in the United States and overseas on a limited appointment basis pursuant to the authority of sections 308 and 309 of the Foreign Service Act of 1980 ( 22 U.S.C. 3948 and 3949). The authority to hire individuals contained in paragraph
(1)shall expire on September 30, 2021. The account charged for the cost of an individual hired and employed under the authority of this subsection shall be the account to which the responsibilities of such individual primarily relate: Provided , That funds made available to carry out this subsection may be transferred to, and merged with, funds appropriated by this Act in title II under the heading Operating Expenses . Individuals hired and employed by USAID, with funds made available in this Act or prior Acts making appropriations for the Department of State, foreign operations, and related programs, pursuant to the authority of section 309 of the Foreign Service Act of 1980 ( 22 U.S.C. 3949 ), may be extended for a period of up to 4 years notwithstanding the limitation set forth in such section. Funds appropriated under titles III and IV of this Act to carry out the provisions of part I of the Foreign Assistance Act of 1961, including funds appropriated under the heading Assistance for Europe, Eurasia and Central Asia , may be used, in addition to funds otherwise available for such purposes, for the cost (including the support costs) of individuals detailed to or employed by USAID whose primary responsibility is to carry out programs in response to natural disasters, or man-made disasters subject to the regular notification procedures of the Committees on Appropriations. Funds appropriated by this Act to carry out chapter 1 of part I, chapter 4 of part II, and section 667 of the Foreign Assistance Act of 1961, and title II of the Food for Peace Act ( Public Law 83–480 ; 7 U.S.C. 1721 et seq.), may be used by USAID to employ up to 40 personal services contractors in the United States, notwithstanding any other provision of law, for the purpose of providing direct, interim support for new or expanded overseas programs and activities managed by the agency until permanent direct hire personnel are hired and trained: Provided , That not more than 15 of such contractors shall be assigned to any bureau or office: Provided further , That such funds appropriated to carry out title II of the Food for Peace Act ( Public Law 83–480 ; 7 U.S.C. 1721 et seq.), may be made available only for personal services contractors assigned to the Office of Food for Peace. In entering into multiple award indefinite-quantity contracts with funds appropriated by this Act, USAID may provide an exception to the fair opportunity process for placing task orders under such contracts when the order is placed with any category of small or small disadvantaged business. Individuals hired pursuant to the authority provided by section 7059(o) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2010 (division F of Public Law 111–117 ) may be assigned to or support programs in Afghanistan or Pakistan with funds made available in this Act and prior Acts making appropriations for the Department of State, foreign operations, and related programs. Funds made available by this Act are made available to support the permanent Foreign Service and Civil Service staff levels of USAID at not less than the levels funded in fiscal year 2016. Not later than 60 days after enactment of this Act, and every 60 days thereafter until September 30, 2021, the USAID Administrator shall report to the appropriate congressional committees on the on-board personnel levels, hiring, and attrition of the Civil Service, Foreign Service, and foreign service national workforce of USAID, on an operating unit-by-operating unit basis: Provided , That such report shall also include a hiring plan, including timelines, for maintaining the permanent Foreign Service and Civil Service at not less than the levels funded in fiscal year 2016. Not later than 30 days after enactment of this Act, and quarterly thereafter until September 30, 2021, the USAID Administrator shall submit a report to the appropriate congressional committees on the status of USAID’s reorganization as described in the report accompanying this Act. The use of funds appropriated by this Act to implement any plan to expand or reduce the size of the permanent Civil Service or Foreign Service workforce at USAID from funded levels in fiscal year 2016 shall be subject to prior consultation with, and the regular notification procedures of, the Committees on Appropriations: Provided , That such notification shall include the requirements enumerated in section 7062(b) of this Act. Programmatic, funding, and organizational changes resulting from implementation of the Foreign Assistance Review shall be subject to prior consultation with, and the regular notification procedures of, the Committees on Appropriations: Provided , That such notifications may be submitted in classified form, if necessary.
