Section 395 of title 10, United States Code, is amended— in subsection (b)(3), by inserting , signed by the Secretary, after written notification ; and in subsection (c)— in paragraph (1)— in subparagraph (A), by striking and after the semicolon at the end; by redesignating subparagraph
(B)as subparagraph (C); and by inserting after subparagraph
(A)the following new subparagraph: is determined to— have a medium or high collateral effects estimate; have a medium or high intelligence gain or loss; have a medium or high probability of political retaliation, as determined by the political military assessment contained within the associated concept of operations; have a medium or high probability of detection when detection is not intended; or result in medium or high collateral effects; and ; and in paragraph (2)(B), by striking outside the Department of Defense Information Networks to defeat an ongoing or imminent threat .
