Sec. 1047. Report on Department of Defense participation in Export Administration Regulations license application review process

Not later than 180 days after the enactment of this Act, and every 180 days thereafter until the date that is three years after such date of enactment, the Under Secretary of Defense for Policy shall submit to the congressional defense committees a report on the participation by the Department of Defense in the process for reviewing applications for export licenses under the Export Administration Regulations as a reviewing agency under Executive Order 12981 ( 50 U.S.C. 4603 note; relating to administration of export controls). The report required by subsection
(a)shall include the following: The number of applications for export licenses under the Export Administration Regulations reviewed by the Department of Defense in the 180-day period preceding the submission of the report. The number of instances during that 180-day period in which the Department disagreed with a final determination made with respect to such an application under the review procedures set forth in Executive Order 12981. A summary of such instances, including— a summary of the applicants for such licenses and the recipients of items pursuant to such licenses in such instances; a description of sensitive technologies involved in such instances; and a description of the rationale of the Department for disagreeing with such determinations. The number of such applications under review by the Department or undergoing interagency dispute resolution as of the date of the submission of the report. The report required by subsection
(a)shall be submitted in unclassified form but may include a classified annex. In this section, the term Export Administration Regulations means subchapter C of chapter VII of title 15, Code of Federal Regulations.
