Section 1172 of the Water Infrastructure Improvements for the Nation Act ( 33 U.S.C. 2354 ) is amended— by redesignating subsection
(c)as subsection (d); and by inserting after subsection
(b)the following: The Secretary shall grant an easement across water resources development project land for the electric, telephone, or broadband service facilities of a nonprofit organization that is eligible for financing under the Rural Electrification Act of 1936 ( 7 U.S.C. 901 et seq.) if the easement does not interfere with the safe functioning of the water resources development project. The placement of an easement under paragraph
(1)shall be at the discretion of the Secretary. .
