Section 105(a)(1) of the Water Resources Development Act of 1986 ( 33 U.S.C. 2215(a)(1) ) is amended— in subparagraph (A), by striking The Secretary and inserting Except as provided in subparagraph (F), the Secretary ; and by adding at the end the following: In the case of a feasibility study described in clause (ii), the Federal share of the cost of the study shall be, as determined by the Secretary— not less than 50 percent; and not more than 100 percent. A feasibility study referred to in clause
(i)is a feasibility study for a project for mitigation of damage to an area affected by weather or other events for which— during the 8-year period ending on the date of enactment of the America's Water Infrastructure Act of 2018 — the Secretary provided emergency response under section 5 of the Act of August 18, 1941 (commonly known as the Flood Control Act of 1941 ) (55 Stat. 650, chapter 377; 33 U.S.C. 701n ); or the area received disaster assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act ( 42 U.S.C. 5121 et seq.); and there is a significant risk for future similar events (as determined by the Secretary). .
