Section 502 of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 352 ) is amended by inserting after subsection
(dd)the following: If it is a nonprescription drug that is not the subject of an application approved under section 505, and does not comply with the requirements under section 505G. If it is a drug for which fees under section 744L–1 have been assessed but have not been paid. .
