Not later than 1 year after the date of enactment of this Act, the Secretary shall develop a categorical exclusion (as defined in section 1508.4 of title 40, Code of Federal Regulations (or a successor regulation)) to carry out a forest management activity on National Forest System land in any case in which at least 2 of the primary purposes of the forest management activity are— to address an insect or disease infestation; to treat land at risk of insect or disease infestation; to reduce hazardous fuel loads; to protect a municipal water source; to maintain, enhance, or modify critical habitat to protect the habitat from catastrophic disturbances; to increase water yield; to achieve salvage operation objectives; or any combination of the purposes specified in paragraphs
(1)through (7). In developing and administering a categorical exclusion under subsection (a), the Secretary shall— be consistent with the National Environmental Policy Act of 1969 ( 42 U.S.C. 4321 et seq.); and apply the extraordinary circumstances procedures under section 220.6 of title 36, Code of Federal Regulations (or a successor regulation), in determining whether to use the categorical exclusion.
