Title 18, United States Code, is amended by inserting after chapter 27 the following: 581. Enhanced penalties for drug trafficking and crimes committed by illegal aliens. Any alien unlawfully present in the United States, who commits, conspires to commit, or attempts to commit a an offense under Federal, State, or Tribal law, that has, as an element, the use or attempted use of physical force or the threatened use of physical force or a deadly weapon or a drug trafficking crime (as defined in section 924) shall be fined under this title imprisoned for not less than 5 years, or both. Any alien unlawfully present in the United States who violates subsection
(a)and was ordered removed under the Immigration and Nationality Act ( 8 U.S.C. 1101 et seq.) on the grounds of having committed a crime before the violation of subsection (a), shall be fined under this title, imprisoned for not less than 15 years, or both. Any term of imprisonment imposed under this section shall be consecutive to any term imposed for any other offense. . The table of chapters at the beginning of part I of title 18, United States Code, is amended by inserting after the item relating to chapter 27 the following: 28 .
