Notwithstanding any other provision of law, if the Secretary of Homeland Security determines that the acquisition of a leasehold interest in real property and the construction or modification of any facility on the leased property are necessary to facilitate the implementation of this Act, the Secretary may— acquire a leasehold interest; construct or modify such facility; accept real or personal property donations of any value through U.S. Customs and Border Protection’s Donations Acceptance Program under the Cross-Border Trade Enhancement Act of 2016 ( Public Law 114–279 ) or through other public-public or public-private partnership arrangements at any location at which U.S.
Customs and Border Protection operates; and designate any leasing action as exempt from Federal lease scoring rules.
