Notwithstanding section 102(h) of the Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996 ( 22 U.S.C. 6032(h) ) and section 910(b) of the Trade Sanctions Reform and Export Enhancement Act of 2000 ( 22 U.S.C. 7209(b) ), and except as provided in subsection (b), none of the funds appropriated or otherwise made available by this Act or by any other Act may be used to implement any law, regulation, or policy that prohibits the provision of technical services otherwise permitted under an international air transportation agreement in the United States for an aircraft of a foreign air carrier that is en route to or from Cuba based on the restrictions set forth in part 515 of title 31, Code of Federal Regulations (commonly known as the Cuban Assets Control Regulations ): , That passengers on such aircraft engaged in a stop for non-traffic purposes as permitted under the agreement shall be exempt from part 515 of title 31, Code of Federal Regulations.
Provided This section shall not apply to foreign carriers that— are owned by the Government of Cuba or are based in Cuba; or do not otherwise have a license to make transit stops in the United States. Nothing in this section may be construed to limit the authority of the President to restrict stops for non-traffic purposes described in subsection (a), or any transaction incident to such transit stops, on a case-by-case basis, if such restriction is important to the national security of the United States.
