Funds provided by this Act for Project 99–D–143, Mixed Oxide Fuel Fabrication Facility, and any funds provided by prior Acts for such Project that remain unobligated, may be made available only for construction and project support activities for such Project. The Secretary of Energy may waive the requirement under subsection
(a)if the Secretary concurrently submits to the Committees on Appropriations of both Houses of Congress— the commitment, certification, and details described in section 3121(b) of the National Defense Authorization Act for Fiscal Year 2018 ( Public Law 115–91 ; 131 Stat. 1892); and the lifecycle cost estimate used to make such certification. If the Secretary waives the requirements under subsection (a), the Secretary may not use funds provided for the Project described in such subsection to eliminate such Project until the date that is 30 days after the submission of the lifecycle cost estimate required under subsection (b)(2).
