Section 21(m)(1)(B) of the Arms Export Control Act ( 22 U.S.C. 2761(m)(1)(B) ) is amended— by striking
(B)is not and inserting (B)(i) is not ; by striking ; and and inserting ; or ; and by adding at the end the following: is significant military equipment (as defined in section 47(9) of this Act) and the Secretary of State has provided prior approval of the return of such defense article from the foreign country or international organization; and .
