Sec. 101. Duties of the Attorney General

The Attorney General shall carry out this section in consultation with— the Director of the Bureau of Prisons; the Director of the Administrative Office of the United States Courts; the Director of the Office of Probation and Pretrial Services; the Director of the National Institute of Justice; and the Director of the National Institute of Corrections. The Attorney General shall, in accordance with subsection (c)— develop a prisoner risk and needs assessment system in accordance with section 102; develop recommendations regarding recidivism reduction programs and productive activities in accordance with section 103; conduct ongoing research and data analysis on— the best practices relating to the use of prisoner risk and needs assessment tools; the best available risk and needs assessment tools and the level to which they rely on dynamic risk factors that could be addressed and changed over time, and on measures of risk of recidivism, individual needs, and responsivity to recidivism reduction programs; the most effective and efficient uses of such tools in conjunction with recidivism reduction programs, productive activities, incentives, and rewards; which recidivism reduction programs are the most effective for addressing the different risks and specific criminogenic needs of prisoners, and the volume and intensity of programming that most effectively reduces the risk of recidivism for prisoners with different risks of recidivating; which prerelease custody options are most effective for prisoners with different risks of recidivating; and products purchased by Federal agencies that are manufactured overseas and could be manufactured by prisoners participating in a prison work program without reducing job opportunities for other workers in the United States; on a biennial basis, review the system developed under paragraph
(1)and the recommendations developed under paragraph (2), using the research conducted under paragraph (3), to determine whether any revisions or updates should be made, and if so, make such revisions or updates; hold periodic meetings with the individuals listed in subsection
(a)at intervals to be determined by the Attorney General; and report to Congress in accordance with section 104. In carrying out the duties under subsection (b), the Attorney General shall— consult relevant stakeholders; and make decisions using data that is based on the best available statistical and empirical evidence.
