Section 47107 of title 49, United States Code, as amended by this Act, is further amended by adding at the end the following: In fiscal year 2021 and each fiscal year thereafter, the Secretary of Transportation may approve an application under this subchapter for an airport development project grant only if the Secretary receives written assurances that the airport owner or operator will maintain— a lactation area in the sterile area of each passenger terminal building of the airport; and a baby changing table in one men’s and one women’s restroom in each passenger terminal building of the airport. The requirement in paragraph
(1)shall only apply to applications submitted by the airport sponsor of a medium or large hub airport. On application by an airport sponsor, the Secretary may determine that a lactation area in existence on the date of enactment of this Act complies with the requirement in paragraph (1), notwithstanding the absence of one of the facilities or characteristics referred to in the definition of the term lactation area in this subsection. The requirement in paragraph
(1)shall not apply with respect to a project grant application for a period of time, determined by the Secretary, if the Secretary determines that construction or maintenance activities make it impracticable or unsafe for the lactation area to be located in the sterile area of the building. In this section, the term— lactation area means a room or similar accommodation that— provides a location for members of the public to express breast milk that is shielded from view and free from intrusion from the public; has a door that can be locked; includes a place to sit, a table or other flat surface, a sink or sanitizing equipment, and an electrical outlet; is readily accessible to and usable by individuals with disabilities, including individuals who use wheelchairs; and is not located in a restroom; and sterile area has the same meaning given that term in section 1540.5 of title 49, Code of Federal Regulations. . Section 47119(a) of title 49, United States Code, is amended by adding at the end the following: In addition to the projects described in paragraph (1), the Secretary may approve a project for terminal development for the construction or installation of a lactation area (as defined in section 47107(w)) at a commercial service airport. .
