Privately funded actions taken by private parties on private land do not constitute Federal actions under the National Flood Insurance Act of 1968 ( 42 U.S.C. 4001 et seq.), the Flood Disaster Protection Act of 1973 ( 42 U.S.C. 4001 et seq.), the Biggert-Waters Flood Insurance Reform Act of 2012 ( Public Law 112–141 , 126 Stat. 916), and the Homeowner Flood Insurance Affordability Act of 2014 ( Public Law 113–89 ; 128 Stat. 1020), that require consultation under section 7 of the Endangered Species Act of 1973 ( 16 U.S.C. 1536 ).
