For purposes of this subtitle: The term agency has the meaning given such term under section 311. The term direct costs has the meaning given such term under section 421(3) of the Congressional Budget and Impoundment Control Act of 1974 ( 2 U.S.C. 658(3) ), except that— in the case of a Federal intergovernmental mandate, the term means the aggregate estimated amounts that all State, local, and Tribal governments would incur or be required to spend or would be prohibited from raising in revenues in order to comply with the Federal intergovernmental mandate; and in the case of a Federal private sector mandate, the term means the aggregate estimated amounts that the private sector will be required to spend or could forgo in profits, including costs passed on to consumers or other entities taking into account, to the extent practicable, behavioral changes, in order to comply with the Federal private sector mandate.
Except as provided under paragraphs
(1)and (2), the definitions under section 421 of the Congressional Budget and Impoundment Control Act of 1974 shall apply to this subtitle.
