Sec. 5009. Report on groundwater contamination

Not later than 180 days after the date of enactment of this Act, and annually thereafter for the next 4 years, the Secretary of the Navy shall submit a report to Congress on the groundwater contamination from the site that includes— a description of the status of the groundwater contaminants that are leaving the site and migrating to a location within a 10-mile radius of the site, including— detailed mapping of the movement of the plume over time; and projected migration rates of the plume; an analysis of the current and future impact of the movement of the plume on drinking water facilities; and a comprehensive strategy to prevent the groundwater contaminants from the site from contaminating drinking water wells that, as of the date of the submission of the report, have not been affected by the migration of the plume.
In this section, the following definitions apply: The term comprehensive strategy means a plan for— the remediation of the plume under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 ( 42 U.S.C. 9601 et seq. ); or corrective action under the Solid Waste Disposal Act ( 42 U.S.C. 6901 et seq. ). The term groundwater means water in a saturated zone or stratum beneath the surface of land or water. The term plume means any hazardous waste (as defined in section 1004 of the Solid Waste Disposal Act ( 42 U.S.C. 6903 )) or hazardous substance (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 ( 42 U.S.C. 9601 )) found in the groundwater supply.
The term site means the site located at 830 South Oyster Bay Road, Bethpage, New York, 11714 (Environmental Protection Agency identification number NYD002047967).
