Sec. 375. Vocational rehabilitation services and information and referral services

Vocational rehabilitation services provided under this subtitle are any services necessary to assist an individual with a disability in preparing for, securing, retaining, or regaining an employment outcome, consisting of— the adult training services listed in section 315; job-related services, including individual assessment, counseling, guidance, job search and placement assistance, job retention services, follow-up services, and follow-along services; vocational and other training services, including the provision of personal and vocational adjustment services, books, tools, and other training materials; diagnosis and treatment of physical and mental impairments; transportation, including adequate training in the use of public transportation vehicles and systems, that is provided in connection with the provision of any other service described in this section and needed by the individual to achieve an employment outcome; on-the-job or other related personal assistance services provided while an individual is receiving other services described in this section; interpreter services provided by qualified personnel for individuals who are deaf or hard of hearing, and reader services for individuals who are determined to be blind; rehabilitation technology, including telecommunications, sensory, and other technological aids and devices; transition services for students with disabilities, that facilitate the achievement of positive employment outcomes; supported employment services; specific postemployment services necessary to assist an individual with a disability to retain, regain, or advance in employment; and any other services necessary to assist an individual with a disability in preparing for, securing, retaining, or regaining an employment outcome.
In the event that the vocational rehabilitation services cannot be provided to all eligible individuals with disabilities in the State who apply for the services, the State plan shall— show the order to be followed in selecting eligible individuals to be provided the vocational rehabilitation services; provide the justification for the order of selection; and include an assurance that, in accordance with criteria established by the State for the order of selection, individuals with the most significant disabilities will be selected first for the provision of the vocational rehabilitation services.
The State shall ensure that individuals with disabilities are appropriately referred to Federal and State programs (other than the program carried out under this subtitle), including other programs made available through the statewide workforce investment system in the State. An appropriate referral made under paragraph
(1)shall be a referral to the Federal or State program covered by paragraph
(1)that is best suited to address the specific employment needs of an individual with a disability.
