A State or local educational agency that receives funds made available under this Act may use such funds to implement section 8546 of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 7926 ) and to support the costs of implementing or expanding criminal background checks for school personnel in accordance with State or local law. Notwithstanding any other provision of law, any local educational agency or school that receives funds under title VII of the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 7701 et seq. ) that are made available under this Act shall not be subject to requirements that are the same or substantially similar to the requirements of section 578 of S. 2943 of the 114th Congress, as reported by the Committee on Armed Services on May 18, 2016.
