Sec. 724. Authority to convert military medical and dental positions to civilian medical and dental positions

Chapter 49 of title 10, United States Code, is amended by inserting after section 976 the following new section: A military medical or dental position within the Department of Defense may not be converted to a civilian medical or dental position unless the Secretary of Defense determines that— the position is not a military essential position; conversion of the position would not result in the degradation of medical care or the medical readiness of the armed forces; and conversion of the position to a civilian medical or dental position is more cost effective than retaining the position as a military medical or dental position, consistent with Department of Defense Instruction 7041.04.
In this section: The term military medical or dental position means a position for the performance of health care functions within the armed forces held by a member of the armed forces. The term civilian medical or dental position means a position for the performance of health care functions within the Department of Defense held by an employee of the Department or of a contractor of the Department. The term military essential , with respect to a position, means that the position must be held by a member of the armed forces, as determined in accordance with regulations prescribed by the Secretary.
The term conversion , with respect to a military medical or dental position, means a change of the position to a civilian medical or dental position, effective as of the date of the manning authorization document of the military department making the change (through a change in designation from military to civilian in the document, the elimination of the listing of the position as a military position in the document, or through any other means indicating the change in the document or otherwise). .
The table of sections at the beginning of chapter 49 of such title is amended by inserting after the item relating to section 976 the following new item: 977. Conversion of military medical and dental positions to civilian medical and dental positions: limitation. . Section 721 of the National Defense Authorization Act for Fiscal Year 2008 ( Public Law 110–181 ; 10 U.S.C. 129c note) is repealed.
