The Cape Arundel Disposal Site selected by the Department of the Army as an alternative dredged material disposal site under section 103(b) of the Marine Protection, Research, and Sanctuaries Act of 1972 ( 33 U.S.C. 1413(b) ) and reopened pursuant to section 113 of the Energy and Water Development and Related Agencies Appropriations Act, 2014 ( Public Law 113–76 ; 128 Stat. 158) (referred to in this section as the ‘‘Site’’) may remain open until the earlier of— the date on which the Site does not have any remaining disposal capacity; the date on which an environmental impact statement designating an alternative dredged material disposal site for southern Maine has been completed; or the date that is 5 years after the date of enactment of this Act.
The use of the Site as a dredged material disposal site under subsection
(a)shall be subject to the conditions that— conditions at the Site remain suitable for the continued use of the Site as a dredged material disposal site; and the Site not be used for the disposal of more than 80,000 cubic yards from any single dredging project.
