The Bureau of Indian Education and the Office of Management and Budget shall jointly develop a 10-year plan to bring up to good condition, as determined by the facilities evaluation process of the Department of the Interior, in compliance with all applicable tribal requirements all of the following Bureau of Indian Education school facilities: An elementary or secondary day or boarding school operated by the Bureau of Indian Education. A school operated pursuant to the Indian Self-Determination and Education Assistance Act ( 25 U.S.C. 450 et seq. ).
A tribally controlled school (as defined in section 5212 of the Tribally Controlled Schools Act of 1988 ( 25 U.S.C. 2511 )). A dormitory operated by the Bureau of Indian Education for students attending a school other than a school specified in paragraphs
(1)through (3). The plan developed under subsection
(a)shall include— proposed budget requests and timelines; and additional factors such as increasing enrollment capacities. For the purpose of developing the plan under subsection
(a)only, section 1125(a)(5) of the Education Amendments of 1978 ( 25 U.S.C. 2005(a)(5) ) shall not apply. As soon as practicable after completion of the plan developed under subsection (a), the Secretary shall submit a report describing the plan to— the Subcommittee on Interior, Environment, and Related Agencies of the Committee on Appropriations of the Senate; the Committee on Indian Affairs of the Senate; the Subcommittee on Interior, Environment, and Related Agencies of the Committee on Appropriations of the House of Representatives; and the Committee on Natural Resources of the House of Representatives.
