In this title: The term Authority means the Puerto Rico Financial Responsibility and Management Assistance Authority established by section 311(a). The term Chief Financial Officer means the Chief Financial Officer of Puerto Rico appointed under section 352(a). The term Commonwealth means the Commonwealth of Puerto Rico. The term Commonwealth government means— the government of the Commonwealth (including any department, agency, or instrumentality of the government of the Commonwealth); an independent agency of the Commonwealth or any other agency, board, or commission established by the Governor or the Legislative Assembly; the courts of the Commonwealth; the Legislative Assembly; and any other agency, public authority, pension fund, or public benefit corporation established by the Commonwealth that has the authority to receive amounts directly or indirectly from the Commonwealth (other than amounts received from the sale of goods, the provision of services, or the loaning of funds to the Commonwealth).
The term Commonwealth government does not include the Authority. The term control period means— in the case of a public corporation, a control period for the public corporation initiated under section 322(a)(2); and in the case of the Commonwealth government, a control period for the Commonwealth government initiated under section 322(b)(2). The term control year means any fiscal year for which a financial plan and budget for a public corporation or the Commonwealth government approved by the Authority under section 323 or 324 is in effect.
The term emergency manager means an emergency manager for a public corporation appointed under section 322(a)(5)(A). The term financial plan and budget means— in the case of a public corporation, a financial plan and budget developed for the public corporation under section 323; and in the case of the Commonwealth government— a financial plan and budget for the Commonwealth government developed under section 324; and a budget of the Commonwealth government for any fiscal year that is subject to a financial plan and budget described in clause (i).
The term Governor means the Governor of the Commonwealth. The term Legislative Assembly means the Legislative Assembly of Puerto Rico. The term public corporation means an entity created by Commonwealth law as a public corporation. The term public corporation includes— the Aqueduct and Sewer Authority; the Convention Center District Authority; the Electric Power Authority; the Highway and Transportation Authority; the Housing Finance Authority; the Industrial Development Company; the Infrastructure Financing Authority; the Port of the Americas Authority; the Ports Authority; the Public Buildings Authority; the Public Finance Corporation; the Sales Taxes Financing Corporation; and the University of Puerto Rico.
The term Secretary means the Secretary of the Treasury.
