The Expedited Funds Availability Act ( 12 U.S.C. 4001 et seq. ) is amended— in section 601(1) ( 12 U.S.C. 4001(1) ), by inserting , spending account (as defined in section 924(a) of the Electronic Fund Transfer Act), after deposit account ; and in section 603 ( 12 U.S.C. 4002 ), by adding at the end the following: Funds deposited in an account by the transmission by the accountholder of an image of a check using a mobile device or computer shall be available on the same schedule as a check deposited at an automated teller machine under this section. The Board, jointly with the Director of the Bureau of Consumer Financial Protection, may increase the time period described in paragraph
(1)if the Board, jointly with the Director of the Bureau of Consumer Financial Protection, determines that such an increase is necessary to prevent fraud. .
