The Reclamation Safety of Dams Act of 1978 is amended by— in section 3 ( 43 U.S.C. 507 ), in the first sentence, by striking Construction and inserting Except as provided in section 5B, construction ; and inserting after section 5A ( 43 U.S.C. 509a ) the following: Subject to subsection (b), notwithstanding section 3, if the Secretary makes a determination described in paragraph (2), the Secretary may develop additional project benefits through the construction of new or supplementary works on a project— in conjunction with the activities of the Secretary under section 2; and subject to the conditions described in the relevant feasibility study. A determination referred to in paragraph
(1)is a determination by the Secretary that an additional project benefit (including additional conservation storage capacity) is— necessary; in the interests of— the United States; and the project; feasible; and not inconsistent with the purposes of this Act. The costs associated with developing an additional project benefit under subsection
(a)shall be— allocated to the authorized purposes of the project that have a benefit; subject to a cost-sharing agreement among applicable Federal, State, and local agencies relating to the additional project benefit; and repaid in accordance with the reclamation laws. .
