Section 2812(d)(2) of the Public Health Service Act ( 42 U.S.C. 300hh–11(d)(2) ) is amended— by redesignating the three sentences as subparagraphs (A), (B), and (C), respectively, and indenting accordingly; in subparagraph (A), as so redesignated, by striking An and inserting ; In general.— An in subparagraph (B), as so redesignated, by striking With and inserting ; Application to training programs.— With in subparagraph (C), as so redesignated, by striking In and inserting ; and Responsibility of labor secretary.— In by adding at the end the following new subparagraphs:
In the event of an injury to such an intermittent disaster response appointee, the position of the employee shall be deemed to be one which would have afforded employment for substantially a whole year , for purposes of section 8114(d)(2) of such title. The weekly pay of such an employee shall be deemed to be the hourly pay in effect on the date of the injury multiplied by 40, for purposes of computing benefits under section 8118 of such title. .
