Section 291 of the Immigration and Nationality Act ( 8 U.S.C. 1361 ) is amended— by striking to the satisfaction of the consular officer and inserting by clear and convincing evidence ; and by striking to the satisfaction of the Attorney General and by inserting by clear and convincing evidence . Section 214(b) of such Act ( 8 U.S.C. 1184(b) ) is amended by striking establishes to the satisfaction of the consular officer, and inserting establishes by clear and convincing evidence to the consular officer, . The amendments made by this section shall apply with respect to applications filed on or after the date of the enactment of this Act.
