Section 28103(a) is amended— in paragraph (2), by striking $200,000,000 and inserting $295,000,000, except as provided in paragraph (3). ; and by adding at the end the following: The liability cap under paragraph
(2)shall be adjusted every 5 years by the Secretary of Transportation to reflect changes in the Consumer Price Index-All Urban Consumers. The Federal Government shall have no financial responsibility for any claims described in paragraph (2). . Section 28103(e) is amended— in the heading, by striking and inserting Definition .— ; Definitions .— in paragraph (2), by striking ; and and inserting a semicolon; in paragraph (3), by striking the period at the end and inserting ; and ; and by adding at the end the following: the term rail passenger transportation includes commuter rail passenger transportation (as defined in section 24102). . No Federal funds may be appropriated for the purpose of paying for the portion of an insurance premium attributable to the increase in allowable awards under the amendments made by subsection (a). The amendments made by subsection
(a)shall be effective for any passenger rail accident or incident occurring on or after May 12, 2015.
