Chapter 63 is amended by adding at the end the following: The Director shall establish, on behalf of the Secretary, a port performance statistics program to provide nationally consistent measures of performance of, at a minimum— the Nation’s top 25 ports by tonnage; the Nation’s top 25 ports by 20-foot equivalent unit; and the Nation’s top 25 ports by dry bulk. Not later than January 15 of each year, the Director shall submit an annual report to Congress that includes statistics on capacity and throughput at the ports described in subsection (a). The Director shall collect monthly port performance measures for each of the United States ports referred to in subsection
(a)that receives Federal assistance or is subject to Federal regulation to submit an annual report to the Bureau of Transportation Statistics that includes monthly statistics on capacity and throughput as applicable to the specific configuration of the port. The Director shall collect monthly measures, including— the average number of lifts per hour of containers by crane; the average vessel turn time by vessel type; the average cargo or container dwell time; the average truck time at ports; the average rail time at ports; and any additional metrics, as determined by the Director after receiving recommendations from the working group established under subsection (c). The Director may consider a modification to a metric under subparagraph
(A)if the modification meets the intent of the section. The Director shall obtain recommendations for— specifications and data measurements for the port performance measures listed in subsection (b)(2); additionally needed data elements for measuring port performance; and a process for the Department of Transportation to collect timely and consistent data, including identifying safeguards to protect proprietary information described in subsection (b)(2). Not later than 60 days after the date of the enactment of the Port Performance Act , the Director shall commission a working group composed of— operating administrations of the Department of Transportation; the Coast Guard; the Federal Maritime Commission; U.S. Customs and Border Protection; the Marine Transportation System National Advisory Council; the Army Corps of Engineers; the Saint Lawrence Seaway Development Corporation; the Advisory Committee on Supply Chain Competitiveness; 1 representative from the rail industry; 1 representative from the trucking industry; 1 representative from the maritime shipping industry; 1 representative from a labor organization for each industry described in subparagraphs
(I)through (K); 1 representative from a port authority; 1 representative from a terminal operator; representatives of the National Freight Advisory Committee of the Department; and representatives of the Transportation Research Board of the National Academies. Not later than 1 year after the date of the enactment of the Port Performance Act , the working group commissioned under this subsection shall submit its recommendations to the Director. The Director shall ensure that the statistics compiled under this section are readily accessible to the public, consistent with applicable security constraints and confidentiality interests. . Section 6307(b)(1) is amended by inserting or section 6314(b) after section 6302(b)(3)(B) each place it appears. Section 6307(b)(2)(A) is amended by inserting or section 6314(b) after section 6302(b)(3)(B) . The table of contents for chapter 63 is amended by adding at the end the following: 6314.
