Section 5322 of title 49, United States Code, is amended— in subsection (b)— in paragraph (1), in the paragraph heading, by striking and inserting Program established ; In general by redesignating paragraph
(2)as paragraph (3); by inserting after paragraph
(1)the following: A program eligible for assistance under subsection
(a)shall— provide skills training, on-the-job training, and work-based learning; offer career pathways that support the movement from initial or short-term employment opportunities to sustainable careers; address current or projected workforce shortages; replicate successful workforce development models; or respond to such other workforce needs as the Secretary determines appropriate. ; in paragraph (3), as so redesignated— in subparagraph (G), by striking and at the end; in subparagraph (H), by striking the period at the end and inserting ; and ; and by adding at the end the following: give priority to minorities, women, individuals with disabilities, veterans, low-income populations, and other underserved populations. ; and by adding at the end the following: A recipient of assistance under this subsection shall— identify the workforce needs and commensurate training needs at the local level in coordination with entities such as local employers, local public transportation operators, labor union organizations, workforce development boards, State workforce agencies, State apprenticeship agencies (where applicable), university transportation centers, community colleges, and community-based organizations representing minorities, women, disabled individuals, veterans, and low-income populations; and to the extent practicable, conduct local training programs in coordination with existing local training programs supported by the Secretary, the Department of Labor (including registered apprenticeship programs), and the Department of Education. A recipient of assistance under this subsection shall demonstrate outcomes for any program that includes skills training, on-the-job training, and work-based learning, including— the impact on reducing public transportation workforce shortages in the area served; the diversity of training participants; the number of participants obtaining certifications or credentials required for specific types of employment; employment outcomes, including job placement, job retention, and wages, using performance metrics established in consultation with the Secretary and the Secretary of Labor and consistent with metrics used by programs under the Workforce Innovation and Opportunity Act ( 29 U.S.C. 3101 et seq. ); and to the extent practical, evidence that the program did not preclude workers who are participating in skills training, on-the-job training, and work-based learning from being referred to, or hired on, projects funded under this chapter without regard to the length of time of their participation in the program. ; and in subsection (d), by striking paragraph
(4)and inserting the following: The Secretary may use not more than 1 percent of the amounts made available to carry out this section to provide technical assistance for activities and programs developed, conducted, and overseen under this subsection. Not more than 0.5 percent of the amounts made available to a recipient under sections 5307, 5337, and 5339 is available for expenditure by the recipient, with the approval of the Secretary, to pay not more than 80 percent of the cost of eligible activities under this subsection. A recipient may use amounts made available under paragraph
(A)to carry out existing local education and training programs for public transportation employees supported by the Secretary, the Department of Labor, or the Department of Education. .
