Sec. 12203. Grant program for achievement in transportation for performance and innovation

In this section: The term eligible entity includes— a State; a unit of local government; a tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act ( 25 U.S.C. 450b )); and a metropolitan planning organization. The term State means— a State; the District of Columbia; the Commonwealth of Puerto Rico; and any other territory (as defined in section 165(c)(1) of title 23, United States Code). The Secretary shall establish a competitive grant program to reward— achievement in transportation performance management; and the implementation of strategies that achieve innovation and efficiency in surface transportation.
The purpose of the program under this section shall be to reward entities for the implementation of policies and procedures that— support performance-based management of the surface transportation system and improve transportation outcomes; or use innovative technologies and practices that improve the efficiency and performance of the surface transportation system. An eligible entity may submit to the Secretary an application for a grant under this section. An application under paragraph
(1)shall indicate the means by which the eligible entity has met the requirements and purpose of the program under this section, including by— establishing, and making progress toward achieving, performance targets that exceed the requirements of title 23, United States Code; using innovative techniques and practices that enhance the effective movement of people, goods, and services, such as technologies that reduce construction time, improve operational efficiencies, and extend the service life of highways and bridges; and employing transportation planning tools and procedures that improve transparency and the development of transportation investment strategies within the jurisdiction of the eligible entity. In awarding a grant under this section, the Secretary shall take into consideration the extent to which the application of the applicable eligible entity under subsection (d)— demonstrates performance in meeting the requirements of subsection (c); and promotes the national goals described in section 150(b) of title 23, United States Code. Amounts made available to carry out this section shall be used for projects eligible for funding under— title 23, United States Code; or chapter 53 of title 49, United States Code. The amount of a grant under this section shall be not more than $15,000,000. There is authorized to be appropriated out of the general fund of the Treasury to carry out this section $150,000,000 for each of fiscal years 2016 through 2021, to remain available until expended. The Secretary shall withhold a reasonable amount of funds made available under paragraph
(1)for administration of the program under this section, not to exceed 3 percent of the amount appropriated for each applicable fiscal year. Amounts made available under this section shall be administered as if the funds were apportioned under chapter 1 of title 23, United States Code.
