Section 104 of title 23, United States Code, is amended— in subsection (a)(1) by striking subparagraphs
(A)and
(B)and inserting the following: $456,000,000 for fiscal year 2016; $465,000,000 for fiscal year 2017; $474,000,000 for fiscal year 2018; $483,000,000 for fiscal year 2019; $492,000,000 for fiscal year 2020; and $501,000,000 for fiscal year 2021. ; in subsection (b)— in the matter preceding paragraph (1), by striking and the congestion mitigation and air quality improvement program and inserting the congestion mitigation and air quality improvement program, the national freight program ; in each of paragraphs (1), (2), and
(3)by striking paragraphs
(4)and
(5)each place it appears and inserting paragraphs (4), (5), and (6), and section 213(a) ; in paragraph (1), by striking 63.7 percent and inserting 65 percent ; in paragraph (2), by striking 29.3 percent and inserting 29 percent ; in paragraph (3), by striking 7 percent and inserting 6 percent ; in paragraph (4), in the matter preceding subparagraph (A), by striking determined for the State under subsection
(c)and inserting remaining under subsection
(c)after making the set-asides in accordance with paragraph
(5)and section 213(a) ; by redesignating paragraph
(5)as paragraph (6); by inserting after paragraph
(4)the following: For the national freight program under section 167, the Secretary shall set aside from the amount determined for a State under subsection
(c)an amount determined for the State under subparagraphs
(B)and (C). The total amount set aside for the national freight program for all States shall be— $1,000,000,000 for fiscal year 2016; $1,450,000,000 for fiscal year 2017; $2,000,000,000 for fiscal year 2018; $2,300,000,000 for fiscal year 2019; $2,400,000,000 for fiscal year 2020; and $2,500,000,000 for fiscal year 2021. The Secretary shall distribute among the States the total set-aside amount for the national freight program under subparagraph
(B)so that each State receives an amount equal to the proportion that— the total apportionment determined under subsection
(c)for a State; bears to the total apportionments for all States. Of the amount set aside under this paragraph for a State, the Secretary shall use to carry out section 134 an amount determined by multiplying the set-aside amount by the proportion that— the amount apportioned to the State to carry out section 134 for fiscal year 2009; bears to the total amount of funds apportioned to the State for that fiscal year for the programs referred to in section 105(a)(2), except for the high priority projects program referred to in section 105(a)(2)(H) (as in effect on the day before the date of enactment of MAP–21 ( Public Law 112–141 ; 126 Stat. 405). ; and in paragraph
(6)(as redesignated by subparagraph (G)), in the matter preceding subparagraph (A), by striking determined for the State under subsection
(c)and inserting remaining under subsection
(c)after making the set-asides in accordance with paragraph
(5)and section 213(a) ; and in subsection
(c)by adding at the end the following: For each of fiscal years 2016 through 2021, the amount for each State of combined apportionments for the national highway performance program under section 119, the surface transportation program under section 133, the highway safety improvement program under section 148, the congestion mitigation and air quality improvement program under section 149, the national freight program under section 167, the transportation alternatives program under section 213, and to carry out section 134, shall be determined as follows: The initial amount for each State shall be determined by multiplying the total amount available for apportionment by the share for each State, which shall be equal to the proportion that— the amount of apportionments that the State received for fiscal year 2014; bears to the amount of those apportionments received by all States for that fiscal year. The initial amounts resulting from the calculation under clause
(i)shall be adjusted to ensure that, for each State, the amount of combined apportionments for the programs shall not be less than 95 percent of the estimated tax payments attributable to highway users in the State paid into the Highway Trust Fund (other than the Mass Transit Account) in the most recent fiscal year for which data are available. For each of fiscal years 2016 through 2021, on October 1, the Secretary shall apportion the sum authorized to be appropriated for expenditure on the national highway performance program under section 119, the surface transportation program under section 133, the highway safety improvement program under section 148, the congestion mitigation and air quality improvement program under section 149, the national freight program under section 167, the transportation alternatives program under section 213, and to carry out section 134 in accordance with subparagraph (A). . Section 104(d)(1)(A) of title 23, United States Code, is amended by striking subsection (b)(5) each place it appears and inserting paragraphs (5)(D) and
(6)of subsection
(b). Section 120(c)(3) of title 23, United States Code, is amended— in subparagraph (A), in the matter preceding clause (i), by striking or
(5)and inserting (5)(D), or
(6); and in subparagraph (C)(i), by striking and
(5)and inserting (5)(D), and
(6). Section 135(i) of title 23, United States Code, is amended by striking section 104(b)(5) and inserting paragraphs (5)(D) and
(6)of section 104(b) . Section 136(b) of title 23, United States Code, is amended in the first sentence by striking paragraphs

(5)of section 104(b) and inserting paragraphs

(6)of section 104(b) . Section 141(b)(2) of title 23, United States Code, is amended by striking paragraphs
