Section 604(b) of the Healthy Forest Restoration Act of 2003 ( 16 U.S.C. 6591c(b) ) is amended— by striking The Chief and inserting the following: The Chief ; and by adding at the end the following new paragraph: As part of an agreement or contract under paragraph
(1)for a stewardship contracting project, or as a separate agreement or contract in connection with one or more stewardship contracting projects, the Chief or Director may procure the services of persons who are not Federal employees to perform activities necessary to ensure project for compliance with the National Environmental Policy Act of 1969 ( 42 U.S.C. 4331 et seq. ) and the Endangered Species Act of 1973 ( 16 U.S.C. 1531 et seq. ). Services performed under this paragraph are subject to approval by the Chief, Director, or other responsible official of the Forest Service or Bureau of Land Management. The offset authority provided by subsection (d)(4)(A) and receipts available for expenditure under subsection (e)(2)(B) may be used to cover the cost of services procured under this paragraph. .
