None of the funds provided in this act may be used for open lake disposal of dredged sediment in Lake Erie unless such disposal meets water and environmental standards agreed to by the administrator of a State’s water permitting agency and is consistent with a State’s Coastal Zone Management Plan. If this standard is not met, the Corps of Engineers will maintain its long-standing funding obligations for upland placement of dredged material with cost sharing as specified in section 101 of the Water Resources Development Act of 1986, Public Law 99–662 , as amended by section 201 of the Water Resources Development Act of 1196, Public Law 104–303 ( 33 U.S.C. 2211 ) and section 217(d) of the Water Resources Development Act of 1996, Public Law 104–303 , as amended by section 2005 of the Water Resources Development Act of 2007, Public Law 110–300 ( 33 U.S.C. 2326a(d) ).
