Section 4811(c) of the Atomic Energy Defense Act ( 50 U.S.C. 2791(c) ) is amended by striking not to exceed 6 percent and inserting of not less than 5 percent and not more than 8 percent . Subtitle B of title XLVIII of such Act ( 50 U.S.C. 2791 et seq. ) is amended by inserting after section 4811 the following new section: A covered facility that is funded out of funds available to the Department of Energy for national security programs may carry out facility-directed research and development.
The Secretary of Energy shall prescribe regulations for the conduct of facility-directed research and development under subsection (a). Of the funds provided by the Department of Energy to covered facilities, the Secretary shall provide a specific amount, not to exceed 4 percent of such funds, to be used by such facilities for facility-directed research and development. In this section: The term covered facility means a nuclear weapons production facility or the Nevada Site Office of the Department of Energy.
The term facility-directed research and development means research and development work of a creative and innovative nature that, under the regulations prescribed pursuant to subsection (b), is selected by the director or manager of a covered facility for the purpose of maintaining the vitality of the facility in defense-related scientific disciplines. . The table of contents for the Atomic Energy Defense Act is amended by inserting after the item relating to section 4811 the following new item:
