Section 1202(e) of the John Warner National Defense Authorization Act for Fiscal Year 2007 (Public Law 109–364; 120 Stat. 2413), as most recently amended by section 1217(b) of the National Defense Authorization Act for Fiscal Year 2014 (Public Law 113–66; 127 Stat. 909), is further amended by striking December 31, 2014 and inserting December 31, 2015 . In the case of equipment loaned to the military forces of another nation under the authority of section 1202 of the John Warner National Defense Authorization Act for Fiscal Year 2007, as amended by subsection (a), that is damaged or destroyed as a result of combat operations during coalition operations while held by the forces to which loaned, the Secretary of Defense may, with respect to such equipment and without regard to the date of loan of such equipment under such authority, waive any applicable requirement under subchapter I of chapter 138 of title 10, United States Code, for— reimbursement; replacement-in-kind; or exchange of supplies or services of an equal value.
Any waiver under this subsection may be made only if the Secretary determines that the waiver is in the national security interest of the United States. Any waiver under this subsection may be made only on a case-by-case basis.
