Section 1886(d)(12) of the Social Security Act ( 42 U.S.C. 1395ww(d)(12) ) is amended— in subparagraph (B)— in the subparagraph heading, by inserting after for fiscal years 2005 through 2010 ; and increase in the matter preceding clause (i), by striking and for discharges occurring in the portion of fiscal year 2014 beginning on April 1, 2014, fiscal year 2015, and subsequent years ; in subparagraph (C)(i)— by striking fiscal years 2011, 2012, and 2013, and the portion of fiscal year 2014 before and inserting fiscal year 2011 and subsequent fiscal years, each place it appears; and by striking or portion of fiscal year after during the fiscal year ; and in subparagraph (D)— in the heading, by striking and inserting Temporary applicable percentage increase ;
Applicable percentage increase for fiscal year 2011 and subsequent fiscal years by striking fiscal years 2011, 2012, and 2013, and the portion of fiscal year 2014 before April 1, 2014 and inserting fiscal year 2011 or a subsequent fiscal year ; and by striking or the portion of fiscal year after in the fiscal year . Notwithstanding any other provision of law, for purposes of fiscal year 2014, the Secretary of Health and Human Services may implement the provisions of, and the amendments made by, this section through program instruction or otherwise.
