Section 31310(d) is amended by— inserting after the following: Controlled Substance Violations .— An individual who receives a verified positive DOT drug test is disqualified from operating a commercial motor vehicle and remains disqualified until the individual completes the substance abuse professional evaluation and treatment and return to duty process under part 40, subpart O of title 49, Code of Federal Regulations. ; and inserting
(2)before The Secretary .
