The independent panel established by the Secretary of Defense under section 576(a)(2) of the National Defense Authorization Act for Fiscal Year 2013 ( Public Law 112–239 ; 126 Stat. 1758), known as the judicial proceedings panel , shall conduct a review and assessment of— the impact of the use of mental health records by the defense during the preliminary hearing conducted under section 832 of title 10, United States Code (article 32 of the Uniform Code of Military Justice), and during court-martial proceedings; and the use of mental health records in civilian criminal legal proceedings in order to identify any significant discrepancies between the two legal systems.
The judicial proceedings panel shall include the results of the review and assessment in one of the reports required by section 576(c)(2)(B) of the National Defense Authorization Act for Fiscal Year 2013.
