Sec. 5106. Access to broadband telecommunications services in rural areas

Section 601 of the Rural Electrification Act of 1936 (7 U.S.C. 950bb) is amended— in subsection (c), by striking paragraph
(2)and inserting the following: In making or guaranteeing loans under paragraph (1), the Secretary shall give— the highest priority to applicants that offer to provide broadband service to the greatest proportion of households that, prior to the provision of the broadband service, had no incumbent service provider; and priority to applicants that offer in their applications to provide broadband service not predominantly for business service, but where at least 25 percent of customers in the proposed service territory are commercial interests. ; in subsection (d)— in paragraph (5)— by striking and at the end of subparagraph (B); by striking the period at the end of subparagraph
(C)and inserting a semicolon; and by adding at the end the following: the amount and type of support requested; and a list of the census block groups or tracts proposed to be so served. ; and by adding at the end the following: The Secretary shall establish a process under which an incumbent service provider which, as of the date of the publication of notice under paragraph
(5)with respect to an application submitted by the provider, is providing broadband service to a remote rural area, may (but shall not be required to) submit to the Secretary, not less than 15 and not more than 30 days after that date, information regarding the broadband services that the provider offers in the proposed service territory, so that the Secretary may assess whether the application meets the requirements of this section with respect to eligible projects. ; in subsection (e), by adding at the end the following: In considering the technology needs of customers in a proposed service territory, the Secretary shall take into consideration the upgrade or replacement cost for the construction or acquisition of facilities and equipment in the territory. ; and in each of subsections (k)(1) and (l), by striking 2012 and inserting 2018 .
