Sec. 1432. Threshold for implementation and reduction in dairy payments

Except as provided in subsection (b), the Secretary shall announce that the stabilization program is in effect and order reduced payments by handlers to participating dairy operations that exceed the applicable percentage of the participating dairy operation’s stabilization program base whenever— the actual dairy production margin has been $6.00 or less per hundredweight of milk for each of the immediately preceding 2 months; or the actual dairy production margin has been $4.00 or less per hundredweight of milk for the immediately preceding month.
If any of the conditions described in section 1436(b) have been met during the 2-month period immediately preceding the month in which the announcement under subsection
(a)would otherwise be made by the Secretary in the absence of this exception, the Secretary shall— suspend the stabilization program; refrain from making the announcement under subsection
(a)to implement order the stabilization payment; or order reduced payments. Reductions in dairy payments shall commence beginning on the first day of the month immediately following the date of the announcement by the Secretary under subsection (a).
