20-400.02. Submittal of data comparing premiums charged to filed rates

On the request of the director, each insurer authorized to write any insurance in this state to which this article applies shall submit data to the director establishing the relationship of the aggregate premiums actually charged policyholders by the insurer for each line of insurance to the premiums produced by the insurer's filed unmodified rates for each line of insurance. A rate service organization may file the data on behalf of the insurer. Any insurer whose data indicates that the aggregate premiums actually charged policyholders for each line of insurance exceed the premiums produced by its filed unmodified rates by more than a percentage established by the director by rule, or fall below the premiums produced by its filed unmodified rates by more than a percentage established and published by the director by rule, shall be examined by the director to determine whether the rating plan or filed unmodified rates comply with sections 20-356 and 20-357 or 20-384 and 20-385.
The director shall prescribe the time period the data are to cover and the form in which the data are to be submitted.
