Sec. 26.05.780. Resistance, flight, breach of arrest, and escape.
A member of the militia who
(1)resists apprehension,
(2)flees from apprehension,
(3)breaks arrest, or
(4)escapes from custody or confinement may be punished by up to one year of confinement, by separation with characterization up to dishonorable discharge, and by such other punishment as a court-martial may direct.
